Terms of Service

1. Who we are
Sendscape is a transactional email service operated by Digital Scape ("Sendscape", "we", "us"). By creating an account or using the service, you agree to these Terms of Service, including the Acceptable Use Policy in section 4. If you do not agree, do not use the service.
2. The service
Sendscape lets you send transactional email through an HTTP API or an SMTP relay from domains you have verified with us. Email is delivered through Amazon Web Services (Amazon SES) infrastructure located in Singapore. The service is currently in beta.
3. Your account
- Provide accurate account information and keep it up to date.
- Keep your API keys, SMTP credentials, and password secret. Anything sent using your credentials is your responsibility.
- You may only send from domains you own or are authorized to use, verified through the dashboard.
4. Acceptable Use Policy
Sendscape is for transactional and legitimately requested email. Every recipient you email through Sendscape must have opted in to receive email from you or have an existing relationship with you that makes the email expected. You are responsible for obtaining and being able to demonstrate that consent.
You must not use Sendscape to send:
- Unsolicited bulk email (spam) of any kind.
- Email to purchased, rented, scraped, or third-party lists.
- Phishing, malware, or content that impersonates another person or organization.
- Content that is illegal in Malaysia or in the recipient’s jurisdiction.
- Email with misleading headers, subject lines, or sender identity.
You must also:
- Honor unsubscribe and opt-out requests promptly.
- Keep your bounce and complaint rates within the thresholds we communicate. Sustained high bounce or complaint rates are a breach of these terms.
5. Quotas, monitoring, and suspension
We set sending quotas per account and may change them. To protect deliverability for all customers and to comply with our upstream provider's policies, we monitor sending metrics such as bounce and complaint rates, and we may pause or suspend your sending at our sole discretion, with or without prior notice. Where practical, we will tell you why and what is needed to restore sending.
6. Fees
Sendscape currently offers a free tier with stated sending limits. We may introduce paid plans, billed in Malaysian Ringgit (MYR). We will give you reasonable notice before any change that affects what you pay.
7. Availability and disclaimer
The service is provided "as is" and "as available", without warranties of any kind. We do not guarantee uptime, delivery times, or inbox placement. Email delivery depends on third parties (including mailbox providers and our upstream infrastructure) that we do not control.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to the fees you paid us in the three months before the claim arose, or RM100 if you have paid no fees. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.
9. Indemnity
You will indemnify and hold Digital Scape harmless from claims, damages, and costs (including reasonable legal fees) arising from the content you send, the recipients you send to, or your breach of these terms, including the Acceptable Use Policy.
10. Termination
You may stop using the service and close your account at any time. We may suspend or terminate your account for breach of these terms. On termination, your API keys and SMTP credentials stop working; we handle your data as described in the Privacy Policy.
11. Changes to these terms
We may update these terms from time to time. Continued use of the service after an update means you accept the new terms. For material changes we will notify you by email or through the dashboard.
